These Website Terms of Use govern your access to and use of https://optique.tinycio.com, its services, and the Subscriber Portal (the "Site"). By using the Site, you accept these Terms of Use. If you do not agree, do not use the Site.

1.2. We may modify these Terms of Use at any time; the updated version is effective upon posting. Continued use constitutes acceptance.

2. Accounts

2.1. Certain features require registration. You agree to provide accurate, current information and to keep it updated.

2.2. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of unauthorized use. We are not liable for losses arising from your failure to follow security practices.

2.3. We may suspend or terminate accounts for violation of these Terms, the Acceptable Use Policy, or law, or for prolonged inactivity.

3. Use of the Site

3.1. You agree to use the Site lawfully and not to interfere with its operation or the rights of others.

3.2. Prohibited: interfering with the Site, attempting unauthorized access, automated scraping without permission, distributing malware, posting unlawful content, and circumventing technical measures. See the Acceptable Use Policy (TC-OPT-COM-AUP).

3.3. Paid services are governed by the Terms of Service (TC-OPT-COM-TOS-MAIN), which control in case of conflict.

4. Intellectual property

4.1. The Site and all its content (design, code, text, graphics, logos, trademarks) are owned by us or our licensors and protected by U.S. and international law.

4.2. No use of Site materials is permitted without our written consent, except as expressly allowed by law. Access to the Site grants no rights in its content.

4.3. By posting content through the Site, you represent you hold the necessary rights and grant us a license to use it as needed to provide the services.

5. Disclaimer; limitation of liability

5.1. The Site is provided "AS IS" and "AS AVAILABLE," without warranties of any kind to the maximum extent permitted by law. We do not warrant uninterrupted or error-free operation or the retention of posted information.

5.2. We are not liable for temporary unavailability, third-party acts, the content of linked external sites, or damages arising from use or inability to use the Site. Our aggregate liability relating to the Site (apart from paid services under the Terms of Service) is limited to USD 100 to the extent permitted by law, and excludes indirect and consequential damages and lost profits.

6. Privacy and cookies

6.1. Personal data is handled under the Privacy Policy (TC-OPT-COM-PRIVACY). The Site uses cookies under the Cookie Policy (TC-OPT-COM-COOKIES).

7. Governing law

7.1. These Terms of Use are governed by the laws of the State of Wyoming, USA, and the dispute-resolution and arbitration provisions of the Terms of Service (TC-OPT-COM-TOS-MAIN) apply.

7.2. If any provision is unenforceable, the remainder remains in effect.
